Terms of Service

These Terms of Service (“Terms”) govern your access to and use of wessages (the “Service”), operated by the company that operates wessages (“we”, “us”). By creating a brief, buying a plan, or otherwise using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

1. What wessages does

wessages produces short, creator-style video advertisements for products, services, venues, apps and experiences using AI. You provide a product, a script, and creative direction; we generate video ads for you to use in your marketing.

2. Eligibility

You must be at least 18 and able to form a binding contract. You must use the Service only for a lawful business promoting a genuine product, service, venue, app or experience you are authorised to advertise.

3. Your content

“Your Content” means everything you submit — product details, scripts, images, and any brand assets. You represent that you own or have the rights to Your Content and that it does not infringe anyone’s rights or break any law. You grant us a licence to use Your Content solely to operate the Service and generate your ads.

4. Output & ownership

Subject to your payment and these Terms, you own the video ads we generate for you (“Output”) and may use them across paid and organic channels. We may retain copies to operate, secure, and improve the Service. You are responsible for how you use the Output, including any advertising, disclosure, and platform rules that apply to AI-generated or endorsement-style content.

5. Acceptable use

You agree not to use the Service to create content that:

• is deceptive, defamatory, hateful, harassing, or unlawful;
• impersonates a real person without rights, or misuses someone’s likeness;
• promotes a product or service you may not lawfully advertise;
• infringes intellectual property, privacy, or publicity rights; or
• attempts to disrupt, reverse-engineer, or abuse the Service or its rate limits.

6. Plans, credits & payment

Paid plans grant a monthly allotment of video credits. Credits are use-it-or-lose-it: an allotment refreshes each billing cycle and does not roll over. Add-on packs top up your balance. Payments are processed by Stripe; by subscribing you authorise recurring charges until you cancel. Prices may change on renewal with notice.

7. Cancellation & refunds

You can cancel any time from your account; access continues until the end of the paid period. Except where required by law, payments are non-refundable. If a specific render fails, the credit for it is automatically returned to your balance. If you are a consumer in the EEA or UK, statutory withdrawal and refund rights may apply and are not affected by this clause.

8. Service availability

We aim for high availability but the Service is provided “as is” and “as available”. Generation depends on third-party infrastructure and may occasionally be delayed or unavailable.

9. Disclaimers & liability

To the fullest extent permitted by law, we disclaim all warranties, and our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential losses, or for how you use the Output. Nothing in these Terms limits liability that cannot be limited by law (for example, for death or personal injury caused by negligence, or fraud).

10. Termination

We may suspend or terminate access if you breach these Terms or use the Service in a way that creates risk or legal exposure. You may stop using the Service at any time.

11. Governing law & disputes

These Terms are governed by the laws of the United States and of the State in which the company that operates the Service is incorporated, without regard to conflict-of-laws rules, and you and we submit to the courts located there for any dispute — except that we may seek injunctive relief in any competent court, and your mandatory local consumer-protection rights are unaffected.

12. Changes

We may update these Terms; material changes will be posted here with a new effective date. Continued use after changes means you accept them.
